ACCEPTANCE OF TERMS AND CONDITIONS - The downloading and use of Data produced by Ouranos Inc. ('Ouranos') indicate your acceptance of the general terms and conditions of use established by Environment Canada ('EC'). Under licence from Ouranos. If you do not agree to the general terms and conditions described hereinafter, you cannot download or use the Data. 2. GRANT OF LICENCE - Ouranos is the owner of all intellectual property rights (including copyright) of the Data and grants EC the right to distribute the Data for end use purposes of research, development and training only You are granted a non-exclusive, perpetual, no-cost and non-transferable licence. This Licence Agreement entitles you to use the Data subject to the terms and conditions presented below. It does not constitute a transfer of rights, in whole or in part.The Data can only be used by you ('the User') and you are not authorized to market, lease, lend, grant sublicences or transfer the Data or any associated rights, to any other party in accordance with the terms herein. 3. REDISTRIBUTION RESTRICTIONS - You are only authorized to make one (1) working copy and one (1) backup copy of the Data. You are not authorized to make copies of the data in whole or in part for purposes of distribution, , except for educational or research and development purposes. You are only entitled to use this Data as part of internal activities relating to non-profit research and educational programs. You are not entitled to use this Data as part of, or as the basis of a database, another product, or service providing access or distribution outside of the organization with which you are involved. 4. FURTHER RESTRICTIONS - You are not authorized not transfer these Data or store the Data on electronic networks, including but not limited to intranets, the World Wide Web, for use by more than one user unless you have obtained explicit permission from EC and have paid additional fees, if necessary. 5. RESEARCH AND EDUCATION - For the purposes of this Licence Agreement, the terms and conditions relating to non-commercial research and educational purposes pertain to activities conducted in an public research facility or academic institution, not funded by business or industrial organizations in Canada or abroad. 6. TRIVIAL PROCESSING OF THE DATA - For the purposes of this Agreement, there are two types of trivial processing. One involves simply changing the Data by converting to other units or values representing different quantities from which the original Data can be recalculated. The other involves changing the format or medium used to store the Data. 7. DISTRIBUTION OF VALUE-ADDED INFORMATION - The User may distribute value-added information for non-commercial, educational or research purposes, providing these products were obtained by transforming the Data in ways other than by trivial processing as described in Clause 6 of this Agreement. The User nevertheless guarantees Ouranos and EC that the Data cannot be recovered or constructed from the value-added information. 8. NO WARRANTY - Ouranos and EC provide no guarantee as to the quality, accuracy or integrity of the Data. These Data are provided on an 'as-is' basis, without any type of warranty or terms and conditions.Ouranos and EC reject all other warranties, expressed or implied, including but not limited to, implicit warranties regarding the Data's marketability or their suitability for a particular purpose. 9. LIMITED LIABILITY - Ouranos and EC are in no way liable for any damages whatsoever resulting from the use of the Data or inability to use the Data, even if Ouranos and EC, as well as the User were informed, beforehand, that such damages could occur. This limited liability is comprehensive, in the sense that it applies to all damages, of any type, including (and not limited to), compensatory damages, direct, indirect or consecutive damages, loss of data, loss of income or profit, loss of goods or material damages and third party claims. 10. LIABILITY - You are required to use this product in accordance with the clauses contained in this Licence Agreement and must obtain all required authorizations from EC if you intend to use the Data in a manner not permitted or specified in this Agreement. 11. TERMINATION - This User Licence Agreement and the rights granted under this Agreement shall be automatically withdrawn if the User fails to comply with the terms and conditions described herein and does not resolve the matter within 30 days following receipt of a written notice from EC or Ouranos. Cessation of use of the Data by the User also automatically terminates this Licence Agreement. 12. ACKNOWLEDGEMENT - The User agrees to recognize the origin of the Data in any publication or public communication by including the following statement: "Based on data produced by Ouranos".
